SECTION 11. Conflict of Interest- Board of Director members shall excuse themselves from any action in which actual conflict of interest arises.
1. The work real is vague and undefined. One legal definition of real conflict of interest—> conflict of interest. n. a situation in which a person has a duty to more than one person or organization, but cannot do justice to the actual or potentially adverse interests of both parties.
a. One example. The STR recommended regulations established limits, or actually no limits on the number of STR permits in the first year. One Board member stated that he just spent $100K on his STR property and must therefore vote to support the “no limits.” However, it was stated in the meeting that “no limits” would have an adverse impact on much of the community. This was demonstrated at the general membership meeting as a large number of members who had never before attended a general membership meeting attended and voted to support the regulations with no limits.
